The stare decisis on the ratio decidendi

I thought I’d share something that has assisted me in finding relevant precedents and obiter for any query… the JADE search bar.

Staying up to date with the latest decisions of Australian and International Courts and Tribunals and Australian legislation has never been easier. New, revised, updated and so much more sophisticated, JADE takes online legal research to a whole new level.

You can simply type in the key words you’re looking for and all the case law mentioning those search terms will appear. It may take a bit of reading of individual published cases, but you will be able to confirm the position of the law by reference to whatever the contention may be. These higher court judgments invariably cite the judgment authorities they rely upon in their decisions, so they provide a great resource in understanding how the courts are obliged to treat a certain premise.

On the bottom of each page you will notice there is a section where the decision has been referred to in recent cases, as an authority on the particular ratio or point of law, so you can easily find the latest decisions in that area of law.
