Ledger Acquisitions Australia MB Pty Ltd v Kiefer [2014] FCCA 2216

The respondent made an application for review of the making of a sequestration order against his estate, but the court ordered that the application for review be dismissed, and published its reasons for judgment in Ledger Acquisitions Australia MB Pty Ltd v Kiefer [2014] FCCA 2216. The grounds in the submissions challenged the jurisdiction of the Federal Circuit Court of Australia, the validity of appointments of Judges and Registrars, the validity of Commonwealth legislation, and whether the Governor-General’s assent to the legislation is valid. He relied on a writ of habeas corpus, and Clause 29 of the Magna Carta in asserting a right to trial by jury in the matter, to which the court delivered a detailed summary. (from 59)
