Like many other failed constitutional theorists, James Rech has styled himself as a “Commonwealth Public Official” which he claims endows him with powers over the judiciary and government.

His contentions are borrowed from vexatious litigants Wayne Glew and Brian Shaw, relating to “the Crown being removed from the states” due to amendments to the Judicial Oaths and also the Queen of Australia.
James Rech was also involved with a few so-called “arrests” of magistrates, including that of Magistrate Ian Watkins by Dezi Freeman at Wangaratta Magistrates Court on Friday the 31st of May 2019.

“Magistrate Studham managed to maintain control of the court and the incident at all times … “I have heard what you have to say but the High Court has already decided these matters.” Magistrate Studham said. “I’m not hearing your matter today. It’s an administrative hearing to be listed for a contest hearing. Do you intend to plead?” she asked.
“I’m arresting you for treason. What is your authority?” Mr Rech continued. After further exchanges of that nature, Ms Studham told Rech that his matter was concluded and he was free to go.
“This is a treasonous court,”Mr Rech shouted while exiting the courtroom. The business of the day continued.”

In 2021 James Rech was back at it, claiming to “arrest” another magistrate and also the prosecutor. Over the phone, of all methods. These CPO’s really make short work of arrests.

Jim Rech was heavily involved in the private prosecution brought by Anthony Herman against Premier Daniel Andrews for “Misprision of treason”. Jim Rech made the announcement in a speech at a Melbourne protest, and despite all the fanfare, the prosecution was dismissed in 5 minutes at Myrtleford Magistrates Court on the 17th December 2021.
